Terms of Service for Airport.Social

Welcome to Airport.Social (the "App" or "Service"), owned and operated by Airport.Social, Inc. (collectively, "Airport.Social," "we," "us," or "our").
PLEASE READ THIS AGREEMENT CAREFULLY. THIS TERMS OF SERVICE AGREEMENT (THE "TERMS" OR "AGREEMENT") GOVERNS YOUR ACCESS TO AND USE OF THE AIRPORT.SOCIAL MOBILE APPLICATION, WEBSITE, SERVICES, AND SOFTWARE. BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE SERVICE.
IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER IN SECTION 11. IT AFFECTS YOUR LEGAL RIGHTS REGARDING HOW DISPUTES ARE RESOLVED. PLEASE READ IT CAREFULLY.
1. Acceptance and Modification of Terms
By downloading, registering for, or using the Service, you represent that you have read, understood, and agreed to be bound by these Terms. We reserve the right, in our sole discretion, to modify, amend, or replace these Terms at any time. If we make material changes, we will notify you through the App or via the email address associated with your account. Your continued use of the Service following the posting of any changes constitutes binding acceptance of those changes.
2. Eligibility and Account Security
To use Airport.Social, you must satisfy the following eligibility criteria. By creating an account, you represent and warrant that:
Age Requirement: You are at least eighteen (18) years of age, or the legal age of majority in your jurisdiction of residence, whichever is older.
Authority: You have the legal capacity to enter into a binding contract under applicable laws.
Prior Bans: You have not been previously suspended, banned, or removed from Airport.Social.
No Offender Status: You are not currently registered as a sex offender, nor are you subject to any active court orders or criminal restrictions regarding harassment, stalking, physical abuse, or sexual misconduct.
Account Security: You are solely responsible for maintaining the confidentiality of your login credentials (including third-party auth provider credentials, such as Apple, Google, or phone OTP codes). You are fully responsible for all activities that occur under your account. You agree to notify us immediately at security@airport.social of any unauthorized use.
3. Description of Service and "Modular Passport" Use
Airport.Social is a hyper-local, real-time social networking and matching application restricted to verified travelers within physical airport terminals.
3.1 The Modular Passport (Profile Modes)
The Service utilizes a single Core Profile (the "Passport") that can switch between three active matching overlays (each a "Match Mode"). You acknowledge that the fields and visibility of your profile vary strictly by the Match Mode you activate:
Business Class (Professional): Geared toward professional networking, industry discussion, and sharing professional lounges.
Layover (Casual): For platonic connections, sharing travel stories, grabbing food/coffee, or general company.
Mile High (Romantic): For flirty, romantic, or high-energy physical connections.
3.2 Mode Guard Visibility Mechanics
Our matching algorithm strictly enforces safety layers ("Mode Guards"). You understand and agree that:
If your account is active in Business Class, your profile and data are completely hidden from any user active in Mile High mode.
Certain profile data (such as your "Private Photo Vault" or specific romantic bios) are completely restricted from query or download by our servers unless both users are actively set to Mile High mode.
While we utilize software restrictions to enforce these boundaries, you agree that you input and post sensitive or romantic information on your profile at your own risk.
4. Aviation Environments & Compliance with Security Laws
Airport.Social operates inside highly sensitive national and international infrastructure. You acknowledge that your use of the App must strictly conform to airport regulations.
TSA & Airport Security Regulations: You must strictly abide by all Transportation Security Administration (TSA) regulations, Federal Aviation Administration (FAA) laws, local airport authority regulations, and border control rules.
No Security Bypassing: You shall not use Airport.Social to solicit or facilitate unauthorized access to secured areas of any airport, bypass security screening checkpoints, trespass onto restricted terminal zones, or violate customs boundaries.
Interference with Operations: You agree not to use the App in any manner that interferes with airport operations, airport employees, terminal security personnel, customs officers, or flight crews.
Airline Staff Directions: You must comply at all times with the instructions of flight crews, gate agents, and security officers. If a match, conversation, or meetup on Airport.Social causes you to delay boarding or interfere with terminal traffic, you are solely liable.
5. User Conduct and Prohibited Activities
You agree that you will not use the Service for any unlawful, harmful, or prohibited activities. Prohibited behavior includes, but is not limited to, the following:
5.1 General Prohibited Acts
Harassment and Abuse: Stalking, bullying, harassing, intimidating, or physically threatening any other user of the App.
Commercial Solicitation and Sex Work: Operating commercial ventures, soliciting money, or engaging in, promoting, or facilitating escort services, commercial sex work, or prostitution. Airport.Social enforces a zero-tolerance policy for SESTA/FOSTA violations. Any suspected solicitation of commercial sex will result in an immediate, permanent, non-appealable ban.
Deceptive Behavior: Impersonating any person or entity, using false flight information, checking in to airports where you are not physically present, using another person's likeness as your profile photo, or submitting a verification selfie that is not a live image of yourself for the purpose of obtaining a "Photo Verified" badge.
Intellectual Property Violations: Posting content that infringes upon third-party copyrights, trademarks, or privacy rights.
5.2 Content Guidelines
All User-Generated Content (UGC), including text, profile fields, public photos, and messages, must comply with the following restrictions:
No Public Nudity: Publicly visible photos (including your Core Passport Avatar and Business Class/Layover photos) must not display nudity, explicit sexual acts, graphic violence, or sexually suggestive themes.
The Mile High Photo Vault: Explicit or flirty media may only be uploaded to your private "Mile High Photo Vault," which is restricted strictly to users who have consensually matched with you in Mile High mode. However, we reserve the right to run automated moderations (using hashing algorithms) to prevent the transmission of illegal material.
No Non-Consensual Media: You may not upload, share, or transmit intimate or private images of another person without their express, written consent. Doing so is a violation of international privacy laws and will result in referral to local law enforcement.
6. User-Generated Content (UGC) License and Ownership
Ownership: You retain all intellectual property rights and ownership in the photos, text, profiles, messages, and other materials you post or upload to the Service ("Your Content").
License Grant: By uploading or posting Your Content on Airport.Social, you automatically grant us a non-exclusive, royalty-free, perpetual, transferable, sublicensable, worldwide license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, perform, and display Your Content in connection with operating, developing, and improving our Service. This license is necessary for us to transmit your messages, display your profiles, and store your photos on our database servers (e.g., Supabase).
Photo Verification Selfies: If you submit a live selfie for the optional "Photo Verified" badge, you grant us only a limited, non-exclusive license to transmit that selfie and your primary profile photo to our facial comparison provider for a one-time automated comparison. That selfie is deleted immediately after scoring and is not retained, displayed to other users, or covered by the perpetual display license above.
Review and Moderation: We utilize automated scanning tools, peer-reporting features, and manual human moderation to monitor, edit, or delete any content that we determine, in our sole discretion, violates these Terms or our community standards.
7. Interaction with Other Users & In-Terminal Meetups (Use at Your Own Risk)
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS OF THE SERVICE, BOTH ONLINE AND OFFLINE.
No Background Checks: You understand that Airport.Social does not conduct criminal background checks, identity verification checks, or safety screenings on its users. We do not verify that users are who they claim to be, nor do we verify that they possess valid boarding passes or airline tickets.
"Photo Verified" Badge: Users may optionally submit a live selfie, which our Service automatically compares to their primary profile photo using third-party facial comparison technology (currently AWS Rekognition). A "Photo Verified" badge only confirms that the selfie visually matched the profile photo at the time of comparison — it is not an identity check, government ID verification, age verification, background check, or confirmation of a user's name or other claims. The submitted selfie is discarded immediately after comparison and is not retained. We may revoke or require re-verification of a badge if we believe a profile photo has changed, been misused, or no longer represents the account holder.
"At the Airport" Badge: This badge only confirms that a user's device reported a GPS location near an airport terminal at a specific time. It is not a confirmation that the user cleared a security checkpoint, holds a valid ticket, or is airside.
Airport Meetup Risks: Meetup suggestions provided by the app (e.g., "Starbucks near Gate B12") are generated programmatically for convenience. They do not constitute an endorsement of safety by Airport.Social.
Safety Protocols: We strongly recommend that you exercise extreme caution during meetups. Always meet in busy, well-lit, highly public terminal concourses. Never accompany another user to dark corners, unmonitored parking structures, cargo areas, or off-airport hotel rooms unless you have independently verified your safety and comfort levels.
Release of Liability: YOU HEREBY RELEASE AIRPORT.SOCIAL, INC., AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR DISPUTES, INTERACTIONS, CHATS, OR MEETUPS WITH OTHER USERS OF THE SERVICE.
8. Flight Data and Geolocation Disclaimers
Our App integrates third-party geolocation services (e.g., GPS, Mapbox) and third-party flight information services (e.g., FlightAware AeroAPI) to identify your airport terminal and calculate boarding times.
Data Accuracy Disclaimer: Real-time data regarding flight schedules, boarding times, terminal designations, and gate locations are subject to rapid change and service disruptions. We do not warrant the accuracy, timeliness, or reliability of any flight data, terminal maps, or location calculations shown on the App.
Missed Flight Liability: YOU ACKNOWLEDGE THAT IT IS YOUR SOLE RESPONSIBILITY TO REMAIN AWARE OF YOUR BOARDING TIMELINES, GATE ASSIGNMENTS, AND SECURITY CHECKPOINT LINES. AIRPORT.SOCIAL, INC. IS NOT LIABLE, UNDER ANY CIRCUMSTANCES, FOR MISSED FLIGHTS, CANCELED TICKETS, TRAVEL DELAYS, ADDITIONAL BAGGAGE FEES, LODGING EXPENSES, REBOOKING FEES, OR ANY INDIRECT FINANCIAL LOSSES RESULTING FROM YOUR USE OF THE SERVICE, CHATTING, OR MEETING UP WITH OTHER USERS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIRPORT.SOCIAL, INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
UNDER NO CIRCUMSTANCES WILL AIRPORT.SOCIAL, INC. BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF AIRPORT.SOCIAL, INC. FOR ANY CLAIMS ARISING UNDER THIS AGREEMENT IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO AIRPORT.SOCIAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
10. Indemnification
You agree to defend, indemnify, and hold harmless Airport.Social, Inc., its parent companies, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
Your use of and access to the Service;
Your violation of any term of this Agreement;
Your violation of any third-party right, including without limitation any copyright, property, privacy, or safety right;
Your violation of any TSA, FAA, local airport authority, or federal security regulations; or
Any claim that Your Content caused damage to a third party.
11. Dispute Resolution, Governing Law, and Arbitration
11.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any choice of law or conflict of law provisions.
11.2 Binding Arbitration
Except where prohibited by law, you and Airport.Social agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved solely by binding, individual arbitration under the Rules of the American Arbitration Association (AAA), rather than in a court of law.
11.3 Class Action Waiver
YOU AND AIRPORT.SOCIAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.
12. Termination and Data Retention
Termination by Us: We reserve the right to suspend, terminate, or delete your account at any time, with or without notice, in our sole discretion, for any reason, including if we believe you have violated these Terms or pose a safety threat in aviation environments.
The Departure Wipe (Data Retention): To protect user privacy and discretion, Airport.Social reserves the right to run programmatic garbage collection. This means your active chats, matches, and local "Check-in" history are systematically wiped and purged from our databases two (2) hours after your scheduled flight departure. You acknowledge that you have no expectation of permanent, long-term storage of chats or matches on this platform.
13. Account Suspensions, Bans, Sanctions, and Appeals Process
13.1 Our Right to Enforce Platform Safety
To protect our users, airport staff, and the integrity of the aviation environments in which we operate, we reserve the absolute, unilateral right to investigate any reported violations of these Terms. We may, at our sole discretion, apply a range of sanctions and account actions against any user who breaches these Terms, acts in bad faith, or poses a safety or security risk.
These actions include, but are not limited to:
Formal Warning: A digital notification outlining the violation and demanding immediate compliance.
Profile Moderation: Forced removal of violating profile fields, descriptions, or photos, or locking the ability to edit certain profile cards.
Mode Restriction: Restricting your access to specific match modes (e.g., permanently revoking access to "Mile High" mode while leaving "Business Class" active).
Temporary Suspension: Suspending all account access and matching features for a specified period (e.g., 24 hours, 7 days, or 30 days).
Permanent Ban: Deactivating and permanently purging your account, and blacklisting your device ID, phone number, and linked authentication accounts (Apple, Google, etc.) from ever registering a new profile on the platform.
13.2 Immediate Permanent Ban Offenses
While we typically evaluate violations progressively, we enforce a Zero-Tolerance Policy. An immediate, permanent, and non-appealable ban will occur for any of the following offenses:
Solicitation: Attempting to offer, buy, sell, or trade commercial sex, escort services, or any other financial transaction for physical acts or companionship.
Airport Security Disruptions: Any behavior that results in your detention, questioning, or removal by airport security, local police, TSA, or customs authorities.
Non-Consensual Media Distribution: Uploading or transmitting intimate, private, or sexual images of any individual without their express, verifiable consent.
Hate Speech & Harassment: Targeted harassment, hate speech, stalking, or threats of physical violence against any other traveler or airport personnel.
13.3 The Appeals Process
If your account has been suspended or permanently banned, you may request a review of our decision through our formal Appeals Process.
How to Appeal: You must submit a written appeal to appeals@airport.social within thirty (30) days of the date your account action was enacted. Your email must include your registered phone number/email, your flight check-in details at the time of the ban, and a clear, detailed statement explaining why you believe the account action was enacted in error.
Scope of Review: Our safety team will review the system logs, reported messages, and context of the ban. We will not engage in real-time debates or phone consultations regarding these decisions.
13.4 Final Authority and Non-Reviewability
YOU ACKNOWLEDGE AND AGREE THAT AIRPORT.SOCIAL, INC. IS THE ULTIMATE AND SOLE AUTHORITY REGARDING PLATFORM ADMISSION, RETENTION, SANCTIONING, AND REINSTATEMENT.
All decisions made by our Appeals Team are final, binding, and non-reviewable.
We are under no legal or operational obligation to disclose the specific investigative techniques, internal moderation notes, or proprietary software logs that led to your suspension or ban.
If we deny your appeal, you are permanently prohibited from attempting to bypass our security measures to create a new profile. Any attempt to do so will be viewed as unauthorized access to our computer systems and may be prosecuted to the fullest extent of the law.
14. DMCA and Copyright Intellectual Property Policy
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify our Designated Copyright Agent at dmca@airport.social with the following information:
An electronic or physical signature of a person authorized to act on behalf of the owner of the copyright;
A description of the copyrighted work that you claim has been infringed;
A description of where the material that you claim is infringing is located on the Service (including specific URLs or screenshots);
Your address, telephone number, and email address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
